Are You In FATCA Compliance?

Mon, 29 Jan 2018 11:57:13 -0600

The Foreign Account Tax Compliance Act was enacted by the Congress in 2010 as part of the HIRE Act to combat tax evasion by US persons holding investments in offshore accounts. U.S taxpayers holding financial assets outside the United States must report those assets to the IRS. It's in addition to the long-standing requirement to report with tax return known as FinCEN Form 114. FATCA requires U.S taxpayers who hold foreign financial assets with aggregate value of more than the reporting threshold (at least $50000) to report information about those assets on Form 8938 along with tax returns. Foreign financial assets include foreign financial accounts and foreign non-account assets held for investment (as opposed to held for use in a trade or business), such as foreign stock and securities, foreign financial instruments, contracts with non-US persons and interests in foreign entities. These are to be reported. Penalty for non-compliance is huge. IRS imposes $10,000 failure to file penalty, an additional penalty of up to $50,000 for continued failure to file after IRS notification, and a 40 percent penalty on an understatement of tax attributable to non-disclosed assets.

Our Regulatory Bureaucracy Is Filled With Haters of Capitalism, Corporations and Entrepreneurs

Sun, 01 Oct 2017 10:46:31 -0500

Let's get this straight. We hire University Law Students right out of college to work in the State and Federal Bureaucracy as Regulators. To attract this talent we offer to pay for some of their tuition loan costs. We purposely hire these so-called 'hard workers' because it's hard to keep current regulators when those regulatory employees are always offered jobs by large corporation at much higher pay and with good benefits. These young employees are outgunned and outmatched by their former managers within the bureaucracy who definitely know the ropes and now work on the other side (revolving door problem is alive and well in our regulatory bureaucracies).

Tue, 21 Mar 2017 06:45:51 -0500

Have you ever wondered why rents are so high? Well, people with income property are dealing with supply and demand, as the supply remains steady due to the challenges of ROI for building new apartments, and the demand increases, the prices will not come down. What many do not understand is that all this Agenda 21 or now called Agenda 2030 infiltrating their recommendations down to the city levels around the country, this advice turns up in building codes and regulations. There does not seem to be any slowing down of these regulations at the local level, even if the Trump Administration makes good on Federal Regulation reduction.

Standardization, Uncertainty and Our Federal Government Regulators

Thu, 29 Dec 2016 06:47:38 -0600

Our Federal Government should stay out of regulations that purposely and adversely affect one competitor in industry for the benefit of another - unfortunately with our lobbyists in Washington DC, that's just not what happens. We need standardization for our civilization, but must be very careful how we legislate that, or determine such parameters.

Regulations Often Economically Work Like Additional Taxes On Society

Wed, 28 Dec 2016 07:24:56 -0600

Most folks who have never run a business think all the regulations are a good thing, to protect us all from evil entrepreneurs. Little do they know how much better their lives would be without all those onerous and ridiculous regulations from the blob of bureaucracy. Interestingly enough, when they hear of the small business person's plight, they want government to fix it, which to me is laughable, as they are the problem, not the solution. When discussing this I just said; Okay, but give us entrepreneurs a little credit, we kick ass, and at the end of the day, we will find a way - just get the government out of the way.

Overregulation Dialogue

Sun, 11 Dec 2016 17:06:53 -0600

After the 2016 Presidential Election the stock markets in the US hit all-time highs and even before Trump's inauguration, the Dow is poised to cross 20,000 for the first time. This is surprising because many economists proclaimed that if Donald J. Trump was elected we'd go into recession immediately. Wow, lots of talk and banter with only hollow thinking, I'd say. How can this be you ask? It's simple, Trump said he'd lower the corporate tax, and reduce regulations. Sure, that would do it, the economy will grow at 4-5% in fact, we will have to worry about over-heating, not slowing down. Even the FED is already saying they will need to raise rates soon. Even with the banking crisis in Italy and the challenges of the European Union.

Markets Are Able to Be Made By Regulation

Mon, 08 Aug 2016 06:49:10 -0500

Sometimes politicians say the craziest things, no I am not talking about Donald Trump putting his foot in his mouth so the left-wing media can blow it out of proportion and play the StrawMan Game, rather I am talking about socialist leaning politicians who tell us they can create jobs and fix the economy by making laws, rules, and regulations, increasing taxes and the like? These folks haven't a clue.

PAs and ARNPs and Prescribing Controlled Substances

Fri, 05 Aug 2016 14:33:31 -0500

For many years, medical providers and regulators have wrestled with whether Advance Registered Nurse Practitioners ("ARNPs") and Physician Assistants ("PAs") should be able to prescribe controlled substances. This past legislative session, several bills were signed into law allowing ARNPs and PAs to prescribe controlled substances subject to several limitations and restrictions. This article will set forth a broad overview of the bills. However, if your practice intends to use ARNPs or PAs to prescribe controlled substances, we strongly recommend that each practitioner is educated about the boundaries set forth in the new law. For instance, there are restrictions on prescribing certain controlled substances in certain circumstances, prescribing controlled substances within a pain management clinic, and prescribing controlled substances for persons under age 18. It is important that all practitioners are properly educated prior to engaging in prescribing or dispensing any controlled substances.

Over regulation is killing our economy and hurting jobs in the US, but how can we get our government to knock this off? Some say we need regulation to protect us from big business, but in reality that regulation just increases the costs of everything we buy, rent, borrow, lease or steal (just kidding on that last part). Well, let's take an example of over regulation at the FAA and how it will affect your Christmas. Toy drones are a big seller this year, and now the FAA wants to regulate them, so we should talk about his.

The OIG Addresses Free Patient Transportation Issues

Tue, 03 Nov 2015 15:25:36 -0600

The issue of whether a medical provider can provide free patient transport is one that we are asked to look into a few times every year. Aside from the liability issues that it raises, it is one that we have never been able to justify from an Anti-Kickback and Patient Brokering perspective. The fact is, even given the good intentions of most providers to allow their patients easier access to healthcare, transporting patients to and from your facility or practice is providing them with something of value in return for coming to see you. However, under slightly different facts than we are usually asked to consider the question, last week, the Department of Health and Human Services Office of the Inspector General ("OIG") came to a different conclusion.

Addiction Treatment Is a Story in Search of a Villain

Tue, 15 Sep 2015 14:31:38 -0500

I read an article in a local paper the other day. It was about (a) a guy who owned a treatment center (who has not been charged with committing a crime), (b) a lawsuit filed by a large insurance company against a toxicology lab that the insurer owes millions, and (c) the fact that insurance companies pay a lot for toxicology lab testing. I scratched my head, wondering how there was anything newsworthy there. The "story" being sold by the paper, however, created a story with a villain (the providers of services to people in recovery from drug and alcohol addiction) and a "victim" (people receiving care for addiction). I can't resist responding.

The Reality of the "Economic Realities Test"

Fri, 14 Aug 2015 14:55:42 -0500

Across the healthcare industry, providers and healthcare businesses are consistently faced with the decision of whether to employ or contract with their workers. Whether it's a physician working with a group practice, or a marketer on behalf of a healthcare service, correctly structuring relationships between healthcare businesses and their workers is important. For tax reasons, many workers strongly prefer to enter into independent contractor relationships. However, simply calling oneself an independent contractor is not enough to solidify the relationship. Many times, workers who call themselves independent contractors are actually employees in the minds of the government. And sometimes, so-called "employees" with several part-time positions are actually viewed as independent contractors.

The Anti-Kickback Statute: What Constitutes a "Referral"?

Fri, 14 Aug 2015 14:54:09 -0500

Providers of healthcare items or services are well-served to take note: a Federal Court of Appeals has recently held that "the Anti-Kickback Statute prohibits a doctor from receiving kickbacks that are made in return for a referral. It does not require that the referral be made in return for a kickback." Thus, receiving any unauthorized payment from a health care provider to whom you send patients is a very bad idea.

Managing Managed Care

Mon, 10 Aug 2015 13:29:23 -0500

Due to this attention, many healthcare businesses engage auditors to audit their compliance of claims quarterly or annually. However, in addition to compliance audits, a provider should be auditing their payer interaction to create a dynamic blueprint of denial management and payment recovery.
