DUI attorney phoenix

Thu,24 May 2012 09:03:10 GMT

DUI is an abbreviation for Driving Under Influence. These are laws pertaining to drunken driving offenses. There are a number of potential defenses that can be raised in a given drunk driving case.the majority of drunk driving defenses can be broken down into the following areas: 1. "He wasnt driving" In this defense, intoxication is not enough -- the prosecution must also prove that the defendant was actually driving. 2. Probable cause: In a drunk driving case, evidence will be suppressed if the officer did not have legal cause to stop, detain, and arrest. 3. Implied consent warnings: If the officer did not advise you of the consequences of refusing to take a chemical test, or gave it incorrectly, this may affect admissibility of the test results 4. Miranda rights: Incriminating statements may be suppressed if Miranda warnings were not given at the appropriate time. 5. Testing during the absorptive phase: 6. Blood-alcohol content.

The legal implications of publishing reviews on websites

Mon,02 Jan 2012 10:43:04 GMT

It's an interesting question. As with all reviews, I guess you just have in your disclaimer that content on the site is provided for educational and informational purposes only and you are not responsible for any decisions the reader might make based on the content you've published. I've given some places scathing reviews on Not Delia. The only time I ever had to deal with any comeback was when the manager of the place gave a total refund to compensate for our bad experience. I do think it's only fair to give a right of reply, though. But I don't see how it can be libel to describe a bad experience. Edit - sorry, I forgot, it's happened twice. The first time was a refund and the second was an offer of a free meal..

Can you libel an anonymous person or pen name?

Sat,24 Dec 2011 11:18:27 GMT

That's interesting. Thanks, Mark. As it happens, the person scuttled off after receiving the sharp edge of my tongue. Anyway, the thing is that they were completely anonymous - just using any old name to start causing trouble by blog commenting. On the other hand, I was using my pen name, by which I am fairly well known. It's even my avatar here. It was all very silly, but when you run any kind of website that encourages interaction with the general public then you have to expect to deal with some rather unusual people sometimes..

Criminal sentences being passed on UK rioters

Tue,06 Sep 2011 09:28:32 GMT

What do you think about the sentences being passed down on UK rioters. In particular, I'm interested in cases such as this one: http://www.telegraph.co.uk/news/uknews/crime/8695988/London-riots-Lidl-water-thief-jailed-for-six-months.html Is this far too heavy handed? Or does the government need to show that it has zero tolerance for this kind of lawlessness?.

No Terms and Conditions

Tue,10 May 2011 09:03:17 GMT

When it comes to issues like this in the scales FOR I would suggest that some non monetary items to go in including - reducing 'bother' when problems start developing and creating a professional image. Looking at professional image of course for small value items it may be of no importance but if you are say offering a VA service but don't have them what does that say? Ultimately, there is always a balance to be struck of course, based on cost and benefit in any aspect of a business..

Should this man have been prosecuted?

Sat,07 May 2011 05:32:48 GMT

Personally I think it is a waste or time to prosecute this. Probably an arsey polce type or CPS bod. FWIW this is prosecuted regularly in France..
